Yesterday, Representative Shri Thanedar and Representative Bonnie Watson Coleman introduced the No ICE Deaths in the Dark Act, comprehensive legislation that will ensure that Immigration and Customs Enforcement (ICE) reports quickly and transparently on any deaths that occur in ICE custody. In a reversal from previous policy, ICE is no longer required to report certain deaths that occur within 30 days after release from custody, even when ICE detention or release conditions may have contributed to the death. This legislation would codify Biden-era reporting rules that required full reporting on these and all other deaths in ICE custody.
I will work to require ICE to quickly and transparently report deaths in ICE custody, including certain deaths within 30 days after release.
Occurrences
To require the Director of the U.S. Immigration and Customs Enforcement to carry out notification, review, reporting, and record preservation requirements relating to covered deaths involving U.S. Immigration and Customs Enforcement custody.

Assessments
Thanedar materially advanced the issue by introducing the No ICE Deaths in the Dark Act, and the introduced bill covers the promised post-release death-reporting category within 30 days after release. However, verified evidence only shows the bill as Introduced in House, while a separate verified passage indicates ICE had moved away from the reporting policy. There is no verified evidence that the federal reporting requirement was enacted or implemented as of 2026-10-14, so the outcome remains unresolved rather than delivered or partial.
